1- Introduction
These Terms of Use govern your access to https://kingstourja.com/ (our “Site”) and the purchase or use of any services, content, downloads, or tour bookings (“Services”) provided by Kings Tour Ja, whether as a guest or registered user (“You”). By accessing or using our Site, you agree to comply with these terms. Kings Tour Ja reserves the right to modify these Terms of Use at any time without prior notice. Continuing to use the Site following any updates indicates your acceptance of the revised terms
2 - Visitor Conduct
You agree not to use this Site in any manner that could damage, disable, overburden, or impair Kings Tour Ja’s servers, networks, or connected third-party systems. You must not upload or transmit viruses, Trojan horses, worms, or any malicious code designed to interrupt or harm network operations. Unauthorized access, hacking, password mining, data scraping, email harvesting, or submitting false registration details is strictly prohibited.
3 - Use of Images
All photographs and media on https://kingstourja.com/ are the exclusive property of Kings Tour Ja and are protected under international copyright laws. Unapproved copying, redistribution, publication, or derivative use of any image is strictly prohibited without explicit written consent from Kings Tour Ja.
4 - Use of Trademarks
Trademarks, logos, and brand assets displayed on this Site belong to Kings Tour Ja or third-party owners and cannot be used without prior written authorization. When permitted, logos must maintain their original proportions and remain clearly legible without direct hotlinking. Kings Tour Ja reserves the right to terminate any unapproved or improper use of its brand assets at its discretion.
5 - Cancellation Policy Overview
- 48+ Hours Notice: No cancellation fee.
- 24–48 Hours Notice: 50% penalty charge.
- Less than 24 Hours / Same Day: 100% penalty charge (No refund).
6- Release of Liability & Waiver Agreement
By purchasing tickets or participating in any tour, including Horseback Riding, ATV/Dune Buggy, Zip-lining, Water Sports, Skydiving, Rafting, and other excursions, you acknowledge this is a binding legal agreement. You voluntarily forfeit the right to sue Kings Tour Ja for claims arising from your participation, or the participation of your minor dependents, in any provided activities. Kings Tour Ja (KTJ) is operated through https://kingstourja.com/.
7 - Assumption of Risk
You voluntarily assume all risks associated with land- and water-based tour activities, including exposure to unpredictable weather, physical exertion, slips, falls, marine hazards, and remote medical care access. You acknowledge that animals (such as horses) are inherently unpredictable and may react dangerously to outside stimuli. You authorize Kings Tour Ja to secure emergency medical treatment on your behalf if you are incapacitated.
8 - Indemnity & Legal Binding
This agreement is binding upon your heirs, personal representatives, and legal assigns. You agree to indemnify and hold harmless Kings Tour Ja against all claims, legal actions, liabilities, costs, and attorney fees resulting from your participation in any tour activities.
9 - Photo & Media Release
You grant Kings Tour Ja perpetual permission to record, photograph, and publish media containing your likeness in global marketing across any medium without compensation. Individual clauses within this agreement remain independent and legally severable should any single provision be deemed invalid. You voluntarily assume full responsibility for any injury, loss, or damage incurred during the tour, releasing Kings Tour Ja (“the Company”) and associated cruise line partners from liability, including claims arising from negligence. This agreement is governed under the laws of Jamaica. You certify that you are in suitable physical health, mentally sound, free from impairing substances, and compliant with all safety rules and equipment guidelines.
10 - Participation of Minors
As a parent or legal guardian, you consent to your minor’s participation, accepting all risk assumptions, releases, and legal waivers on their behalf. You grant Kings Tour Ja authorization to obtain emergency medical treatment for the minor if you are not present to do so personally.
11 - Transportation Policy
A 15-minute grace period applies to all scheduled pickup times and locations. Failure to arrive within this window will result in automatic cancellation without a refund, requiring you to arrange private transport. All tours are operated by Jamaica Tourist Board (JTB) licensed partners.
12 - Refund Policy & Additional Terms
- Shore Excursions: 100% refund at 96+ hours’ notice; non-refundable under 96 hours. Kings Tour Ja (KTJ).
- Group Reservations: 100% refund if canceled 60+ days before the reservation; 50% cancellation fee at 45 days; 75% cancellation fee at 30 days; non-refundable under 30 days.
- Rescheduling: Rescheduling is free if requested at least 24 hours in advance. No-shows, tardiness over 5 minutes, or failure to meet physical requirement guidelines forfeit all refund eligibility.
- Weather & Force Majeure: If Kings Tour Ja (KTJ) cancels a tour due to severe weather, safety concerns, or capacity restrictions, clients will be offered the option to reschedule or receive a full refund.
- Fees & Payment: Unutilized tour portions are non-refundable. Any cross-border bank or credit card transaction fees are determined solely by the client’s issuing financial institution, not Kings Tour Ja (KTJ).
